Kumpix Terms of Use

This English version is provided for convenience; in case of any discrepancy, the Turkish version prevails.
These Terms of Use (the "Terms") govern your use of the Kumpix desktop application, the kumpix.com website, the account portal and the related cloud services (together, the "Service") offered by Oğuzhan ÇART under the "Kumpix" brand. In these Terms, Oğuzhan ÇART is referred to as "Kumpix" or "we", and any individual or legal entity using the Service as the "User" or "you".
By creating an account, installing the application or using the Service in any way, you confirm that you have read, understood and accepted these Terms, the Privacy policy, the Subscription terms and the End user license agreement. If you do not accept the Terms, you must not use the Service.

2. Scope of the Service
Kumpix is computer-aided design (CAD) software for the jewelry industry. The Service includes drawing and editing tools, AI model generation, castability, weight and stone reports, export (STL, STEP, 3DM, 3MF, G-code), customer approval links, price quotes and production tools. Kumpix reserves the right to develop, change or discontinue the content and features of the Service; if a material feature is removed, paying users will be notified a reasonable time in advance.
3. Account
3.1. To create an account, you must be at least 18 years old and use a valid email address. If you open an account on behalf of a legal entity, you represent that you are authorized to bind that entity.
3.2. You are responsible for the accuracy of your account information, the confidentiality of your password and all activity carried out through your account. You must notify info@kumpix.com immediately if you become aware of any unauthorized use of your account.
3.3. An account may be active on no more than 3 (three) computers at the same time. Sharing, transferring or selling an account to third parties is prohibited.
3.4. You may close your account at any time from Account → Delete account in the application. When the account is deleted, the data stored in the cloud is deleted as described in the Privacy policy.
4. Plans, trial and payment
4.1. New accounts may use all features free of charge for 14 (fourteen) days. At the end of the trial, the account moves to the Free plan, in which drawing and editing remain available; AI, export and customer links are exclusive to the Pro plan.
4.2. The Pro subscription is billed in advance, monthly or yearly depending on the period you choose, at the price and taxes shown on the order screen, and renews automatically at the start of each period until canceled.
4.3. Payments are collected through Polar Software Inc. ("Polar", polar.sh), acting as Merchant of Record. Receipts and taxes are issued and handled by Polar; your card details never reach Kumpix and are not stored by Kumpix.
4.4. You may cancel your subscription at any time from Account → Manage subscription. Cancellation takes effect at the end of the paid period; Pro features remain available until then.
4.5. Price changes are announced by email at least 30 (thirty) days before they take effect and apply from the first renewal period following the notice. If you do not accept a change, you may cancel your subscription before the renewal date.
5. Right of withdrawal and refunds
The Pro subscription is a service performed electronically and immediately, whose performance begins upon your approval. Under Article 15(1)(ğ) of the Turkish Distance Contracts Regulation, the right of withdrawal does not apply to such services. Nevertheless, Kumpix refunds the fee for the first period upon a request sent to info@kumpix.com within 14 (fourteen) days of the first payment. Details are set out in the Refund policy.
6. Acceptable use
You may not use the Service for purposes that violate applicable law, in a way that infringes the intellectual or industrial property rights of third parties, or in a way that disrupts the operation of the Service, its servers or other users. Any attempt to circumvent license checks, decompile or reverse engineer the software, place an unusual load on the Service with automated tools, or transfer licenses to third parties is prohibited.
7. Intellectual property
7.1. All rights in the Kumpix software, interface, template library, brand, logo and website content belong to Kumpix. These Terms grant you only the right to use the Service and do not transfer any ownership rights.
7.2. The designs and files you create with the Service, and the information about your customers, belong to you. Kumpix processes this content solely to provide the Service to you (saving, creating customer links, processing AI requests) and does not use it to train its own models.
8. AI output and measurements
Models generated by AI and the weight, volume, carat and price values calculated by the Service are estimates provided for information purposes. Before sending a design to production, casting or sale, it is the User's responsibility to check its dimensions, wall thicknesses, stone settings and castability.
9. Limitation of liability
9.1. The Service is provided "as is" and "as available". Kumpix does not guarantee that the Service will be uninterrupted or error-free, but takes reasonable care to fix errors within a reasonable time.
9.2. To the extent permitted by applicable law, Kumpix is not liable for indirect damages such as loss of profit, production errors, loss of material or loss of data. Kumpix's total liability for direct damages is limited to the total amount paid by the User to Kumpix in the 12 (twelve) months preceding the event giving rise to the damage.
9.3. This section does not limit Kumpix's liability arising from intent or gross negligence, or the rights of consumers under applicable law.
10. Suspension and termination
Kumpix may suspend or close accounts that materially breach these Terms, with prior notice depending on the nature of the breach. If Kumpix discontinues the Service entirely, the fee for any paid and unused period will be refunded and you will be given a reasonable time to export your data.
11. Changes
Kumpix may update these Terms. Changes that materially affect your rights are announced by email at least 30 (thirty) days before they take effect. Continuing to use the Service after a change takes effect means that you accept the updated Terms.
12. Governing law and dispute resolution
These Terms are governed by the laws of the Republic of Türkiye. For disputes with users who are consumers, Consumer Arbitration Committees have jurisdiction within the monetary limits announced each year by the Ministry of Trade, and Consumer Courts have jurisdiction above those limits. For disputes with users who are merchants, the Courts and Enforcement Offices of İstanbul (Çağlayan) have jurisdiction.
